Agreement
By installing, accessing, or using CartScale, you agree to these Terms of Service. If you use CartScale on behalf of a business, you represent that you have authority to bind that business to these terms. CartScale is operated by Palliser Productions.
The CartScale service
CartScale helps Shopify merchants create and manage Cart Hold popups, Soft Email Capture popups, Shipping Bars, lead capture, CSV import and export, Klaviyo sync, plan limits, merchant analytics, and support workflows. Features may vary by plan and may change over time.
Merchant responsibilities
You are responsible for how you use CartScale on your Shopify store, including your storefront notices, consent practices, marketing compliance, and the accuracy of your settings.
- You must only import, export, or use email addresses that you are legally allowed to process.
- You are responsible for complying with laws that apply to your store, including GDPR, CAN-SPAM, CASL, the Australian Spam Act, and similar rules.
- You are responsible for configuring Shopify shipping rates. CartScale's Shipping Bar displays progress toward a threshold but does not create or guarantee Shopify shipping rates.
- You should review popup copy, styling, and behavior before relying on it in production.
Plans, trials, and billing
The Free plan does not create a Shopify billing subscription. Paid plans are billed through Shopify Billing. Where a paid plan includes a free trial, billing begins after the trial unless the subscription is cancelled according to Shopify's billing flow. Plan prices, limits, features, and trials may change for future billing periods.
Refunds and cancellation
You can cancel or change plans through Shopify or CartScale where available. Refunds, including any money-back guarantee displayed in CartScale, are handled through Shopify billing where supported and may require you to contact CartScale support at contact@palliserproductions.com.
Revenue attribution and analytics
CartScale revenue figures are estimates. Attribution is based on matching captured leads to orders placed within a defined attribution window, currently 72 hours where available. These figures are not a promise of incremental revenue, profit, or conversion lift. Actual results depend on your store, traffic, offer, products, and marketing practices.
Integrations
If you connect third-party services such as Klaviyo, you authorize CartScale to use the credentials and settings you provide to send relevant lead data to that service on your behalf. You are responsible for your account with each third-party service and for removing or rotating credentials when needed.
Data and privacy
Our Privacy Policy explains what data CartScale collects and how it is used. By using CartScale, you agree that CartScale may process data as described in the Privacy Policy and as needed to provide the service.
Acceptable use
- Do not use CartScale for unlawful, misleading, abusive, or spam-related activity.
- Do not attempt to access another merchant's data or interfere with the service.
- Do not reverse engineer, overload, scrape, or bypass security controls in CartScale.
Availability and changes
We aim to keep CartScale reliable, but the service is provided without uptime guarantees. We may update, suspend, limit, or discontinue features when needed for security, maintenance, compliance, product improvement, or business reasons.
Disclaimer and limitation of liability
CartScale is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee that CartScale will increase revenue, recover carts, prevent abandonment, or operate without interruption. To the maximum extent permitted by law, Palliser Productions will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from your use of CartScale.
Termination
You may stop using CartScale by uninstalling the app or cancelling your paid plan. We may suspend or terminate access if you breach these terms, create security or legal risk, or misuse the service.
